1. Scope and Definitions
1.1 Application
These Terms govern pre-orders placed with Alva Technologies AS ("Alva", "we", "us") for our home energy management system and related products (the "Product").
If these Terms conflict with our General Terms and Conditions of Sale, these Pre-Order Terms take precedence.
1.2 Definitions
- "Pre-Order" – An advance order for a Product not yet available for delivery.
- "Deposit" – A partial payment to secure your pre-order. Fully refundable if you cancel before shipping.
- "Product" – The Alva Link home energy management system and any accessories in your order confirmation.
- "Customer" – You, the person placing the pre-order.
- "Estimated Delivery Date" – When we expect to ship. An estimate, not a guarantee.
- "Order Confirmation" – Our written confirmation of your pre-order with Product details, Deposit amount, and Estimated Delivery Date.
- "Final Shipping Date" – The date we actually ship.
2. Pre-Order Process
2.1 How to Pre-Order
- Select the Product on our website.
- Enter your details (name, address, email, phone).
- Accept these Terms.
- Pay the Deposit.
2.2 Order Confirmation
After we receive your Deposit, we send an Order Confirmation email with your order reference, Product details, total price, Deposit paid, Estimated Delivery Date, and these Terms.
Important: Paying the Deposit alone does not create a binding contract. The contract forms when we send the Order Confirmation. You can cancel before that.
3. Deposit Payment
3.1 Deposit Amount
The Deposit is a percentage of the total purchase price, required to secure your pre-order.
3.2 Payment Methods
We accept:
- Credit/Debit cards (Visa, Mastercard, American Express)
- Bank transfer
- Digital payment services (as specified on our website)
3.3 Charge and Confirmation
Your Deposit is charged immediately. You receive a payment confirmation email within 24 hours with the amount, date, payment method, and transaction reference.
4. Remaining Balance
4.1 Final Payment
The remaining balance is due before shipping. We do not auto-charge. When the Product is ready, we send you a payment invitation. You confirm and pay.
4.2 Notification
The payment invitation includes: final amount due, expected shipping date, final product specifications, and payment instructions. You have a reasonable period to pay.
4.3 Non-Payment
If you don't pay within the specified period:
- We send a reminder.
- If still unpaid after 30 days, we may cancel your order and refund the Deposit.
5. Cancellation and Refund
5.1 Right to Cancel Before Shipping
You can cancel your pre-order at any time before the Product ships. Contact us:

Please provide your order reference number.
5.2 Refund
Cancel before shipping and you receive a full refund of your Deposit, no fees. If you already paid the remaining balance, that's refunded too. We initiate your refund without undue delay, no later than 14 days from your cancellation request. Actual processing times depend on your payment provider.
5.3 14-Day Withdrawal Right
After receiving the Product, you can withdraw within 14 days. No reason needed.
- Notify us (email or withdrawal form) within 14 days of receipt.
- Return the Product in original condition.
- You pay return shipping unless the Product is defective.
We refund the full purchase price within 14 days of receiving your return. See our Right of Withdrawal document for the standard EU withdrawal form.
5.4 Exceptions to Withdrawal
The 14-day withdrawal right does not apply if:
- The Product has been handled beyond what is necessary to determine its nature, characteristics, and function.
- You have downloaded or used digital content after consenting to its supply.
- The Product is custom-made to your specifications.
6. Delivery
6.1 Estimated Delivery Date
The Estimated Delivery Date is based on production and supply chain forecasts. It's an estimate, not a guarantee.
6.2 Delay Notifications
If the delivery timeline changes significantly, we notify you by email. You can cancel anytime before shipping for a full refund. Your statutory rights under the Consumer Purchase Act regarding delayed delivery are not affected.
6.3 Shipping Coverage
We ship to Norway and EU/EEA countries. Availability per country may change based on demand, logistics, or regulations.
If we can't deliver to your country when it's time to ship:
- We notify you.
- You provide an alternative address in a supported country, or cancel for a full refund.
We confirm supported countries and shipping costs before you pay the final balance.
6.4 Shipping Notification
You get a tracking email when we ship, with tracking number, estimated delivery window, and carrier details.
6.5 Risk Transfer
Risk transfers to you upon delivery. Shipping damage claims go to the carrier.
7. Product Changes and Cancellation
7.1 Product Modifications
The Product is under active development. We may change design, specs, features, or components before shipment to improve functionality, meet regulations, handle supply chain issues, or fix technical problems.
You can always cancel before shipment for a full refund, regardless of changes.
7.2 Notification of Changes
Significant changes: we email you. Don't like them? Cancel per Section 5.1.
7.3 Cancellation by Alva
If we cancel the Product (discontinuation, supplier issues, or other business reasons):
- We notify you by email.
- Full refund of all payments within 14 days.
- Alva is not liable for damages or consequential losses.
7.4 Force Majeure
We're not liable for delays or failures caused by circumstances beyond our reasonable control: natural disasters, pandemics, war, terrorism, supplier failure, material shortages, government action, or extreme weather.
If a force majeure event hits, we notify you and provide an updated timeline where possible. You can still cancel anytime before shipping for a full refund.
8. Price Protection
8.1 Price Lock
Your price is locked when you pre-order. Market or website price changes don't affect you.
8.2 Price Decreases
If we lower the price before your order ships, you get the lower price. Your remaining balance adjusts down.
8.3 Price Increases
If we raise the price after your pre-order, you pay the original, lower price.
9. Product Information
9.1 Preliminary Specifications
All specs, images, and product details are preliminary. The final Product may differ. Not happy with the final specs? Cancel per Section 5.1 for a full refund.
9.2 Illustrative Images
Website images are illustrative. The final Product may differ slightly in color, finish, or design.
10. Limitation of Liability
10.1 Excluded Damages
To the maximum extent permitted by law, Alva is not liable for lost profits, revenue, business opportunities, data, or any indirect, incidental, special, or consequential damages.
10.2 Liability Cap
Alva's total liability for pre-order-related disputes shall not exceed the total amount you paid (Deposit + remaining balance). This cap does not apply to statutory warranty claims, repair or replacement obligations, or consumer remedies under forbrukerkjøpsloven.
10.3 Consumer Rights Preserved
Nothing in this section limits your statutory rights as a consumer under Norwegian and EU consumer protection law. This limitation does not reduce your rights to compensation for personal injury, death, or fraud.
11. Consumer Rights
11.1 Statutory Protections
These Terms do not affect your rights as a consumer under:
- Angrerettloven (Norwegian Consumer Rights Act)
- Forbrukerkjøpsloven (Norwegian Consumer Purchase Act)
- EU Consumer Rights Directive 2011/83/EU
- EU Omnibus Directive 2019/2161/EU
You have the right to:
- Receive clear, accurate product information
- Exercise a 14-day withdrawal right (Section 5.3)
- Receive repair or replacement of defective products
- Receive a refund for non-conforming products
- Protection against unfair contract terms
- Protection against aggressive commercial practices

12. Data Protection
12.1 Privacy
We collect your name, address, email, phone, and payment details to process your pre-order (GDPR, Norwegian Personal Data Act). We don't share your data except for payment processing, shipping, and legal compliance.
12.2 Your Rights
You have the right to access, correct, delete, restrict, or port your personal data. To exercise these rights, contact privacy@alva.as.

13. Dispute Resolution
13.1 Talk to Us First

- We respond within 14 days.
- If unresolved within 30 days, you can escalate.
13.2 Complaint Bodies
Before litigation, you may contact Forbrukerrådet or the EU ODR Platform (see Section 11.2).
13.3 Governing Law
Norwegian law governs these Terms. CISG is excluded.
13.4 Jurisdiction
Oslo City Court has jurisdiction. Consumers may also sue in their home country courts.
13.5 Arbitration Exclusion
No binding arbitration. You can go to court or use consumer complaint bodies.

15. Amendments
15.1 Changes to Terms
We may update these Terms. Changes take effect when published on our website.
15.2 Applicable Terms
Your pre-order is governed by the version in effect when you place your order.
15.3 Material Changes
Material changes that negatively affect your rights: we email you at least 30 days before. Don't agree? Cancel your pre-order.
15.4 Continued Use
Using the pre-order service after updates means you accept the new Terms.
16. Severability
If any provision is found invalid or unenforceable, it's severed. The rest stays in force. We replace the invalid provision with one that achieves the same commercial purpose within the law.
